SHARK AUTOMOTIVE TERMS AND CONDITIONS OF SERVICE

ATTENTION: BY AUTHORIZING OR ACCEPTING THE SERVICE DESCRIBED ON ANY WORK ORDER OR INVOICE, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. PLEASE READ THEM CAREFULLY.

1.1. NO WARRANTY FOR PARTS OR SERVICES SHARK AUTOMOTIVE provides all services and parts on an "AS IS" basis. SHARK AUTOMOTIVE EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The customer acknowledges and agrees that the sole warranty for any component or part may be that provided directly by the original part manufacturer, and the customer must pursue any claims directly with the manufacturer.

1.2. ON-SITE AND PREMISES LIABILITY WAIVER The customer acknowledges that entry onto SHARK AUTOMOTIVE property, the service bay, and any surrounding areas is done at their own risk. SHARK AUTOMOTIVE IS NOT RESPONSIBLE OR LIABLE FOR ANY DAMAGE, LOSS, THEFT, ACCIDENT, OR INJURY sustained by any person or vehicle while the person or vehicle is on our premises or property, regardless of the cause.

1.3. ASSUMPTION OF RESPONSIBILITY The customer accepts and assumes all responsibility and liability for the vehicle, including its condition, operation, and roadworthiness, immediately upon taking possession of the vehicle and driving it off the SHARK AUTOMOTIVE premises.

2.1. MANDATORY PAYMENT BEFORE RELEASE PAYMENT IN FULL FOR ALL SERVICES, PARTS, AND ASSOCIATED FEES IS REQUIRED BEFORE THE VEHICLE WILL BE RELEASED TO THE CUSTOMER. NO EXCEPTIONS WILL BE MADE.

2.2. RIGHT TO WITHHOLD AND MECHANIC'S LIEN If payment is not made in full upon completion of services, SHARK AUTOMOTIVE reserves the right to withhold the vehicle and exercise a Mechanic's Lien on the vehicle until all outstanding balances, including service fees, parts costs, and accrued storage fees (as described in Section 3), are paid in full.

2.3. RIGHT TO SELL UNCLAIMED VEHICLES If the outstanding balance remains unpaid for a period of six (6) months following the date the customer was notified of the service completion, SHARK AUTOMOTIVE reserves the right to sell the vehicle, in accordance with applicable state and local laws, to recover the full amount owed for the original services, parts, and all accrued storage fees and administrative costs.

3.1. DAILY STORAGE CHARGES The customer agrees that a storage fee of $50.00 per day will be assessed for any vehicle not picked up following notification that the services provided have been completed. This daily fee will begin accumulating on the day immediately following the service completion date and will continue until the vehicle is picked up and all outstanding balances are paid in full.
